Terms of Service

These terms govern your use of BimmerByte (“BimmerByte”, “we”, “us”). By creating an account or using the service, you agree to them. If you don't agree, don't use the service.

1. What we offer

BimmerByte is an AI-powered coding assistant for BMW enthusiasts. You describe what you want to unlock and we return suggested modules, parameters, values, and step-by-step instructions matched to your vehicle and chosen tool. The output is generated by a large language model from publicly available information — see the disclaimer for the limits of that.

2. Eligibility

You must be at least 16 years old to use BimmerByte. By using the service, you confirm that you meet that requirement and that any vehicle you ask about is yours, or you have the owner's permission to work on it.

3. Accounts

You sign in with a passwordless magic link sent to your email. You are responsible for keeping access to that email address secure. If you suspect unauthorised use, contact us and we'll suspend the account.

4. Acceptable use

  • Don't share, resell, or relicense answers as your own commercial product.
  • Don't scrape, mirror, or feed our output into another AI service.
  • Don't attempt to extract our prompts, bypass quota, or share your account.
  • Don't submit content that is illegal, abusive, defamatory, or that contains other people's personal data.
  • Don't use BimmerByte to plan or carry out anything illegal (tampering with someone else's car, defeating emissions, etc.).

We may suspend or terminate accounts that violate these rules.

5. Plans, billing & quotas

Free accounts get a lifetime allowance of free queries. Paid plans (Pro, Founder) include a periodic query quota — see pricingfor the current terms. A “query” is one AI-generated coding answer; multi-tool requests consume one query per tool and follow-ups count as one query each.

Payments are processed by PayPalin USD. You can pay with a PayPal balance or with any major card on the PayPal page — a PayPal account is not required. Your bank or card statement will show PAYPAL *BIMMERBYTE (or similar). Subscriptions auto-renew until you cancel; cancel any time from your PayPal account, from your BimmerByte account page, or by emailing us.

6. Your content

You retain ownership of the questions, vehicle information, and follow-ups you submit. You grant us a non-exclusive licence to process them so we can generate your answer, send them to our AI provider (currently Google Gemini), store them so you can revisit a query, and use anonymised or aggregated patterns to improve the service.

7. Our content

We own the BimmerByte product, brand, prompts, and software. AI-generated answers are provided to you for your personal use on your own vehicles. You may share an individual answer with a friend or workshop, but you may not republish answers at scale or pass them off as your own original work.

8. AI output disclaimer

AI output can be wrong. Module addresses, parameter names, and recommended values may not match your exact firmware or region. You are solely responsible for verifying every value against your tool and current BMW documentation before flashing. See the full disclaimer for risks (bricked modules, warranty, legal use).

9. Service availability

BimmerByte is provided “as is” and “as available”. We do not offer a service-level agreement and we may take the service offline for maintenance, updates, or capacity reasons. We'll try not to do that during peak hours.

10. Termination

You can delete your account at any time by emailing us. We may suspend or terminate accounts that breach these terms, attempt to defraud our payment provider, or pose a risk to other users or to us. Unused paid quota is generally not refundable on termination for cause; see the refund policy.

11. Limitation of liability

To the maximum extent allowed by law, BimmerByte is not liable for any indirect, incidental, consequential, or punitive damages, or for loss of data, profit, vehicle use, warranty, or coding-related repair costs. Where liability cannot be excluded, our total liability for any claim is limited to the amount you paid us in the twelve months preceding the claim.

12. Indemnity

You agree to indemnify and hold BimmerByte harmless from any third-party claim arising from your use of the service, your breach of these terms, or your violation of any law or third-party right.

13. Governing law

These terms are governed by the laws of the Republic of South Africa. Any dispute will be subject to the exclusive jurisdiction of the South African courts, unless mandatory consumer-protection rules in your country require otherwise.

14. Changes

We may update these terms. Material changes will be flagged on this page with a new “last updated” date. Continued use after a change means you accept the updated terms.
